Terms of use of the chatbot

1. How the chatbot works

The company Wilhelm Böllhoff GmbH & Co KG (hereinafter "Böllhoff") provides the user of the website www.boellhoff.com with a chatbot to answer questions about Böllhoff. The chatbot is a technical dialog system in which only a technical system (artificial intelligence) on the part of Böllhoff communicates with the user in the chat window. When using the chatbot, the user does not face a human, but a machine trained with artificial intelligence

Despite careful selection and training of the artificial intelligence used in the chatbot, Böllhoff does not assume any guarantee, warranty or assurance for the answers, suggestions, information and other content provided by the chatbot and does not adopt the result of the chatbot as its own.

The result of the chatbot serves solely as non-binding information and initial orientation for the user, which in any case and without exception does not replace personal advice and confirmation by a personal Böllhoff employee.

As a technical system, the chatbot does not make any declarations that are binding for Böllhoff and cannot accept any declarations that are binding for Böllhoff, meaning that the entire content of the chat conversation is not legally binding.

Within the chatbot, legally binding declarations by both Böllhoff and the user are excluded.

The user can end the chat at any time by clicking on the button at the top right of the chat window to close the chat. The chat window is automatically closed by the system after 15 minutes of inactivity. It is not possible for the user to call up the chat window again after it has been closed.

2. Liability

If the user clicks to agree to these Terms of Use, the user and Böllhoff agree that Böllhoff and Böllhoff's legal representatives and vicarious agents shall not be liable for the results, answers, suggestions, hints and information provided by the chatbot or for any other content of the chatbot.

This exclusion of liability does not apply in the event of intent or gross negligence on the part of Böllhoff or a legal representative or vicarious agent of Böllhoff or in the event of damages arising from culpable injury to life, limb or health or in the event of any other mandatory statutory liability.

3. Availability

The chatbot is generally available to the user 24 hours a day within the scope of Internet availability. With the exception of the user's own internet usage fees, no costs are incurred for the use of the Böllhoff chatbot. Böllhoff reserves the right to modify or discontinue the chatbot at any time. The chatbot is temporarily unavailable during technically necessary maintenance work on the system. Regardless of availability, the user can contact Böllhoff employees personally during Böllhoff's business hours. 4. Prohibited behavior

The user may only use the chatbot for the intended purpose of providing initial information about Böllhoff. Any use of the chatbot outside this area is prohibited and forbidden. Any use and/or exploitation of the information and answers and content and results generated by the chatbot for advertising purposes or towards third parties outside the Böllhoff Group or for other extraneous purposes is prohibited and forbidden. Actions and activities that are likely to impair the operation of the chatbot or the underlying technical infrastructure are prohibited and forbidden.

5. Applicable law

The law of the Federal Republic of Germany shall apply to the use of the chatbot. However, this choice of law may not result in a consumer being deprived of the protection afforded to him by those provisions which may not be derogated from by agreement under the law of the country in which the consumer has his habitual residence.
